2. DEFINITIONS AND INTERPRETATIONS
Key definitions include Company, User, Services, Website, Conservation Activities, Training Programs, Force Majeure, and Personal Data.
Interpretation rules apply such that singular includes plural, headings do not affect interpretation, and days refer to calendar days unless stated otherwise.
3. ACCEPTANCE AND MODIFICATION OF TERMS
Use of the website or services constitutes acceptance of these Terms.
Users confirm legal capacity to enter agreements and accuracy of provided information.
The Company reserves the right to modify Terms at any time. Continued usage constitutes acceptance.
4. WEBSITE ACCESS AND USAGE
Website availability is not guaranteed and interruptions may occur due to maintenance, technical issues, or extraordinary events.
Users must provide accurate information and safeguard access credentials where applicable.
Prohibited activities include unauthorized access, malicious interference, illegal use, impersonation, and unauthorized copying of content.
5. SERVICES AND PROGRAMS
Services include marine and terrestrial conservation programs, scuba diving and coral restoration training, volunteer opportunities, research participation, coral adoption programs, and custom group conservation experiences.
Programs may involve underwater surveys, coral propagation, ecological monitoring, habitat restoration, and educational outreach.
Volunteer programs may range from short-term assistance to long-term conservation roles.
Additional services include coral adoption initiatives and tailored educational programs.
6. ELIGIBILITY AND PARTICIPATION REQUIREMENTS
Participants must generally be at least 18 years old and provide valid identification.
Medical disclosure is mandatory, and diving participants must meet medical and swimming competency requirements.
Participants must possess appropriate fitness levels and comply with ethical, behavioral, and environmental standards.
Participation may be denied or terminated due to misconduct, medical non-disclosure, or safety risks.
7. BOOKING, REGISTRATION AND CONFIRMATION PROCESS
Bookings are primarily conducted via WhatsApp, website inquiries, email, or phone consultation.
Participants must submit registration documents, medical forms, waivers, identification, and insurance information.
Bookings are confirmed once documentation and payments are completed and eligibility is verified.
Date changes or transfers are subject to availability and administrative fees.
8. PAYMENT TERMS AND FINANCIAL OBLIGATIONS
Payments may be made via bank transfer, Wise, Stripe, or cash on-site where applicable.
Deposits and payment schedules vary depending on program duration.
Volunteer program fees must generally be paid before arrival.
Administrative, equipment, and modification fees may apply.
All payments are processed through secure channels.
9. COMPREHENSIVE REFUND AND CANCELLATION POLICY
The Company operates under a strict no-refund policy due to resource commitments and conservation funding allocation.
Participant cancellations do not qualify for refunds regardless of timing.
Company cancellations may allow rescheduling or program credit.
Medical emergencies and force majeure events may qualify for program credits or transfers.
Donations and coral adoptions are non-refundable.
10. RISK ACKNOWLEDGMENT AND LIABILITY FRAMEWORK
Participants acknowledge inherent risks in marine, terrestrial, and conservation activities including diving hazards, wildlife encounters, environmental exposure, transportation risks, and medical emergencies.
Participants voluntarily assume responsibility for injuries, medical costs, evacuations, and personal property loss.
Safety protocols are maintained but participants must follow instructions and use safety equipment properly.
Unauthorized activities result in participant liability.
Medical emergency response procedures exist but all associated costs remain participant responsibility.
11. TRAINING PROGRAMS AND CERTIFICATION
11.1 Training Delivery
Programs combine certified instructors with experiential conservation learning conducted on-site.
11.2 Diving Training Programs
Courses may include Open Water Diver, Advanced Adventurer, Rescue Diver, and professional-level programs depending on availability.
Training includes theory, confined water skills, open water dives, safety procedures, rescue techniques, equipment-based rescue, missing diver procedures, and emergency action planning.
Professional programs may cover dive leadership, group supervision, and environmental interpretation.
11.3 Certification Authority
Certifications are issued solely by recognized agencies such as SSI. Certification depends on participant competency.
11.4 Certification Limitations
Payment does not guarantee certification; additional training may be required at extra cost.
11.5 Program Modifications
Training programs may change due to safety, weather, equipment, or instructor availability.
12. INTELLECTUAL PROPERTY AND CONTENT RIGHTS
All materials remain Company property or licensors' property. Users may not reproduce or commercially exploit materials without permission.
Participants consent to photography and videography unless written opt-out is provided prior to program start.
13. DATA PROTECTION AND PRIVACY
Personal data is collected for bookings, safety, certification, and communication purposes.
Data protection measures comply with PDPA. Data may be shared with certification bodies or authorities where necessary.
14. USER CONDUCT AND PROHIBITED ACTIVITIES
Participants must not harass others, damage ecosystems, misuse equipment, engage in illegal conduct, or disrupt operations.
Violations may result in removal without refund.
15. PARTNERSHIPS AND THIRD-PARTY SERVICES
Programs may involve independent third-party providers such as boat operators or certification agencies. The Company is not liable for independent provider actions.
16. FORCE MAJEURE AND EXTRAORDINARY CIRCUMSTANCES
Programs may be altered or postponed due to natural disasters, pandemics, government restrictions, or infrastructure failures beyond Company control.
17. DISPUTE RESOLUTION AND LEGAL FRAMEWORK
These Terms are governed by Malaysian and Sabah law. Disputes should first attempt negotiation, then mediation, and finally court proceedings if unresolved.
18. TERMINATION AND SUSPENSION
Participation may be terminated for misconduct, non-payment, or safety violations without refund.
19. LIMITATION OF LIABILITY
To the maximum extent permitted by law, liability is limited and indirect losses are excluded. Participants accept inherent activity risks.
20. INDEMNIFICATION
Participants agree to indemnify the Company against claims resulting from participant negligence or violation of these Terms.
21. GENERAL PROVISIONS
If any clause is unenforceable, remaining provisions remain valid. These Terms represent the entire agreement. Failure to enforce provisions does not waive rights.
